to hunt on state lands? What about public parks? Schools? Historical sites? Seems everything in this area of NY is owned by the state or is a historical place. What is everyones feeling on this. JoAnne

here in Delaware all state owned land is off limits
. i dont usually ask permission to do parks but there are some around here (such as city of wilmington parks) that are also off limits, so its best to check with the parks department. i never ask to hunt public schools but thats just me. |

No person shall deface, remove, destroy or otherwise injure in any manner whatsoever any tree, flower, shrub, fern, moss or other plant, rock, fossil or mineral found or growing on State land, excepting under permit from the Commissioner of Environmental Conservation and the Assistant Commissioner for State Museum and Science Service, pursuant to section 233 of the Education Law as amended by chapter 121 of the Laws of 1958, nor shall songbirds and their nests and other wildlife be molested or disturbed at any time, except during the open season therefor, if any. ![]()

of course it is a pretty grey area as to what "defacing,destroying, or injuring" means isnt it. is digging a plug and replacing it "destroying, or defacing" anything? it certainly isnt "removing" anything. i guess its open to interpretation. i would contact them and find out. ( we have similar code on the books here as well). |

RIP - to be honest with you I did find that regulation but was hoping it did not mean what I thought it meant.
The way I see it is just about everything is state land if it isn't private. Looks like my places to hunt just got really limited. Unless of course I do as you say. Take my dime and run. I am wondering how much they enforce this or is it one of those rules that is on the books and they pull out only if they really need to. I mean if you are camping at a state owned campsite and you put a tent stake in the ground isn't that defacing the property? If you are good at pin pointing I can not see where you would cause any more damage than that. Just my thoughts. JoAnne |

Was doing some research on a certain part of a National Forest that is open for rock collecting, with permit in hand of course, and noticed that metal detectors were allowed, but in the same sentence it stated that digging holes of any size was against the law.
You can bring your detector, just leave your shovel at home... Have a nice day and welcome to your National Forest.. |

i have a book that has all of the states and thier take on hunting on state land. it is rather old, but NY says by permit only, so it must be possible to get a permit.maybe you could inquire about one?
