A couple of places Im researching and gearing up for are privately owned. The owners are not at that location so I will need to send out letters.
This is my first time doing this, I have a basic idea what I will write but I would also like any ideas for good approches in my letter and if I want written permission back should I just send a form for them to sign, date and return to me? Anyone got any good examples? Thanks |

My first letter went out today for permission. I did include a self addressed stamped envelope. I also reassured the owner that I have no intentions on entering the old abandoned house on the property. (Besides, I personally think it would fall over on me if I sneeze on it by mistake!)

Here's a letter i use and seems to work sometimes
Dear Sir, I am requesting permission to search for coins and possible artifacts with a metal detector on your( ......) grounds. I am a dedicated hobbiest and collect and preserve my finds for the pure enjoyment of the hobby. My retrieval methods require the use of small hand tools, such as a screwdriver or a small trowel and I leave no identifiable trace of my activities. I respect all property and will not deface or alter anything in regards to my retrieval. I will not enter any buildings or prohibited areas and will not detect on school days or any other specified days. I would also like to request, that I may have one detecting partner at times, who while with me, will always be within a visual and audible distance. There will be no more that one person at a time with me. Thank you for taking the time to read this request and I will respect your decision. I understand that I will be entering your grounds at my own risk and will hold no liability toward you. I just thought you might want to add some kind of a liablity waiver, such as this to you letter. It may make the land owner feel somewhat at ease that you won't come back with a law suite if someone gets hurt.
Liability Waiver In consideration of permission to use a metal detector to search for and recover buried relics, coins and other artifacts on the property located at _____________________________ and owned by ____________________________. I, _________________________________, agree to release from all liability for personal injury or property damage that I may suffer as a result of the owners negligence while on the owners property only during the period and at the time of such search. This release shall be binding and forever discharge __________________________________, his/her heirs, executors, and administrators, from all actions, causes of action, claims and demands for, upon, or by reason of any damage, loss, injury, or suffering which I may sustain while engaged in metal detecting on the owners property. _____________________________ _________________ Name, Address Date

Now thats legal speak out of my paygrade but sure sounds good to me
It never hurts to be as specific as possible when roaming someones property that they will not be held liable for any mishap on the property unless they shoot ya . HH Bill |

I just finished this form for the landowner to sign and return its a draft may add somethings. **************** Permission for Metal Detecting on PrivateLand Permission is hereby granted to the undersigned metal detectorist for the sole purpose of metal detecting and retrieval on land owned by the undersigned landowner or their agent for the date(s) listed and according to the conditions stated below. In accepting this permit, I agree to assume and release the landowner from any or all liability for personal injuries, property damage, or for the loss of life or property resulting from, or in any way connected with the issuance of this permit. My request letter, still a draft and need to check grammer. Alittle long I think..
******************** To whom it may concern; My name is ____________ and I am a Metal Detecting hobbyist. I am writing this letter to ask permission to access your property for the use of metal detecting to recover and preserve any relics or artifacts. The property is_________________________________ Metal detecting hobbyist live by a code of ethics and I would like to tell you the how we conduct ourselves and the side benefits to allowing us to enjoy our hobby. 1) All holes dug will be quickly refilled. And in most cases you will be unable to tell that a hole has been dug. 2) We voluntarily collect any trash items found on the surface or below in our search area and dispose of it off the property. By allowing metal detecting you are possibly helping to preserve a piece of history while allowing others to enjoy a fun and rewarding hobby. We take pride in our hobby and retrieve pieces of history for ourselves and others who appreciate such items to enjoy. Please do not allow pieces of history to continue to be lost.
